ArtSyncy respects your privacy and is committed to protecting the personal information you provide when you use our website, platform and related services.

This Privacy Policy explains how ArtSyncy collects, uses, stores and discloses personal information and how you can access, correct or raise concerns about the information we hold about you.

For the purposes of this Privacy Policy, “ArtSyncy”, “we”, “us” and “our” refer to CartMagician Pty Ltd, the operator of the ArtSyncy platform.

1. About ArtSyncy

ArtSyncy is a visual production and publishing platform for art commerce.

The platform allows artists, photographers, designers, galleries and other businesses to upload artwork and create, manage and publish digital assets including framed product visuals, room scenes, marketing graphics, videos, augmented reality experiences, interactive 3D assets and structured artwork information.

2. Information We Collect

Depending on how you interact with ArtSyncy, we may collect the following types of information.

Account information

When you create or manage an ArtSyncy account, we may collect:

  • your name;

  • email address;

  • business or organisation name;

  • account credentials;

  • billing and subscription information;

  • account preferences; and

  • communications with us.

Payment information

Payments may be processed by third-party payment providers.

ArtSyncy may receive information relating to your payment, such as payment status, transaction identifiers, billing address, payment method type and limited payment details.

We generally do not store complete credit or debit card numbers.

Artwork and content

When using ArtSyncy, you may upload or provide:

Artwork Intelligence

ArtSyncy may analyse uploaded artwork and related information to generate structured information about an artwork.

Depending on the service, this may include information such as:

  • artwork type;

  • visual style;

  • colours;

  • subject matter;

  • orientation;

  • dimensions;

  • framing and mounting information;

  • descriptive metadata;

  • product attributes;

  • searchable attributes; and

  • other information intended to help organise, present, search, recommend or sell artwork.

Some of this information may be generated using artificial intelligence and machine-learning systems.

Usage and technical information

When you use ArtSyncy, we may automatically collect information such as:

  • IP address;

  • browser type;

  • device type;

  • operating system;

  • pages or features accessed;

  • referring pages;

  • session information;

  • timestamps;

  • interactions with the platform;

  • error and diagnostic information; and

  • approximate location derived from technical information such as an IP address.

Integrations

If you connect ArtSyncy with a third-party service, such as an ecommerce platform, website, cloud-storage service, marketing service or social platform, we may receive information required to establish and operate that integration.

The information available to ArtSyncy depends on the permissions you grant and the third party’s own policies.

  • connect ArtSyncy with third-party platforms;

  • export or publish content at your request;

  • provide customer support;

  • communicate service and account information;

  • improve platform performance, reliability and usability;

  • prevent fraud, abuse and security incidents;

  • understand how the service is being used;

  • comply with legal obligations; and

  • enforce our agreements.

Where required by applicable law, we will obtain consent before using personal information for a purpose that requires consent.

5. Artificial Intelligence and Third-Party Processing

Some ArtSyncy features use artificial intelligence, machine-learning models and cloud infrastructure supplied by third-party providers.

When you request an AI-powered feature, relevant content may be securely transmitted to one or more service providers for processing.

This may include uploaded artwork, images, prompts, instructions, metadata or generated assets.

We use third-party providers only as required to deliver, operate or improve the relevant ArtSyncy service and subject to the contractual arrangements applicable to those providers.

ArtSyncy does not claim ownership of your artwork simply because you upload it or process it through the platform.

Our use of your content is governed by our Terms and Conditions.

6. AI Model Training

Unless we expressly tell you otherwise and obtain any consent required by applicable law or our agreement with you, ArtSyncy does not use your uploaded artwork to train a general-purpose ArtSyncy generative AI model.

Where third-party AI providers process content on our behalf, their handling of submitted data is governed by the commercial/API terms and data-processing arrangements applicable to the services ArtSyncy uses.

We select and configure providers with the objective of protecting customer content, but third-party processing remains subject to the relevant provider’s infrastructure and contractual terms.

7. Cookies and Analytics

ArtSyncy may use cookies and similar technologies to:

  • keep you signed in;

  • remember preferences;

  • maintain security;

  • understand website usage;

  • measure performance;

  • diagnose errors; and

  • improve the service.

Where required, you may be provided with controls to manage non-essential cookies.

You can also control certain cookies through your browser settings, although disabling some cookies may affect platform functionality.

8. Marketing Communications

If you subscribe to marketing communications or where otherwise permitted by law, we may send information about ArtSyncy products, features, updates or offers.

These locations depend on the service providers and infrastructure used by ArtSyncy and may change from time to time.

Where required by applicable privacy law, ArtSyncy will take reasonable steps in relation to overseas disclosures and the protection of personal information.

11. Data Security

We take reasonable technical and organisational measures designed to protect personal information and customer content from misuse, interference, loss, unauthorised access, modification and disclosure.

However, no online platform, transmission method or storage system can guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and should notify us promptly if you believe your account has been compromised.

12. Data Retention

We retain personal information for as long as reasonably necessary to:

  • provide the service;

  • maintain your account;

  • meet contractual obligations;

  • maintain legitimate business records;

  • resolve disputes;

  • prevent fraud or abuse; and

Some information may remain temporarily in backups or system logs after deletion from active systems.

You may request closure of your ArtSyncy account.

Closing an account may result in the deletion or loss of access to artwork information, generated assets, projects and other content associated with the account.

You should download or export any content you wish to retain before closing your account.

Certain records may be retained where required for legal, financial, security, fraud-prevention or legitimate business purposes.

14. Accessing or Correcting Your Information

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, incomplete or out of date.

15. Privacy Complaints

If you believe ArtSyncy has mishandled your personal information, please contact us.

16. Children’s Privacy

ArtSyncy is intended for business and professional use and is not directed toward children.

You must be at least 18 years old, or otherwise legally capable of entering into a binding agreement in your jurisdiction, to create a paid ArtSyncy account unless we expressly permit otherwise.
