ArtSyncy helps artists, photographers, designers, galleries and art businesses turn their artwork into the visual assets and information needed to present, market and sell their work online.

We understand that uploading original creative work to an AI-powered platform requires trust.

This policy explains what happens to your artwork when you use ArtSyncy, how artificial intelligence may interact with it, what rights you retain, and what responsibilities apply when using AI-generated content.

The short version

Your artwork stays yours.

Uploading artwork to ArtSyncy does not transfer ownership of your work to us.

We process your artwork only as reasonably necessary to provide the ArtSyncy services you request, such as creating framed visuals, room scenes, videos, AR experiences, 3D assets and Artwork Intelligence.

Unless we expressly tell you otherwise and obtain any consent required by applicable law or our agreement with you, ArtSyncy does not use your uploaded artwork to train a general-purpose ArtSyncy generative AI model.

Some AI-powered features require artwork and related information to be securely transmitted to third-party AI or infrastructure providers for processing.

AI-generated results can occasionally contain errors or unintended changes. You should review generated assets before publishing or using them commercially.

1. Your Artwork Stays Yours

You retain ownership of the artwork and original content you upload to ArtSyncy.

This includes, where applicable:

  • photographs;

  • paintings;

  • illustrations;

  • digital artwork;

  • graphic designs;

  • prints;

  • product imagery;

  • logos;

  • brand assets; and

  • other original creative material.

Uploading or processing your artwork through ArtSyncy does not transfer ownership of that artwork to ArtSyncy.

We do not acquire copyright in your original artwork simply because you upload it to our platform.

2. Permission to Process Your Artwork

To provide the ArtSyncy service, you grant us a limited permission to process your content.

This allows ArtSyncy to perform actions you request, such as:

  • uploading and storing artwork;

  • resizing or optimising files;

  • placing artwork into frames;

  • creating framed product visuals;

  • placing framed artwork into room scenes;

  • generating AI-assisted imagery;

  • generating videos;

  • creating augmented reality experiences;

  • creating or managing 3D assets;

  • analysing artwork characteristics;

  • generating Artwork Intelligence;

  • generating product descriptions and metadata;

  • exporting assets; and

  • publishing assets to connected services.

This permission does not give ArtSyncy ownership of your artwork.

It exists so we can provide the services you ask us to perform.

3. How ArtSyncy Uses AI

ArtSyncy may use artificial intelligence and machine-learning technologies to automate parts of the visual production and publishing process.

Depending on the features you use, AI may help ArtSyncy:

  • analyse artwork;

  • identify visual characteristics;

  • generate room environments;

  • place artwork into visual scenes;

  • generate video from imagery;

  • generate descriptions;

  • identify colours, subjects and styles;

  • generate searchable artwork attributes;

  • create structured artwork information;

  • assist with product presentation; and

  • prepare information that may help customers and AI-powered shopping experiences discover relevant artwork.

AI is used as a production and analysis tool.

It does not change who owns your original artwork.

4. Artwork Intelligence

ArtSyncy may analyse uploaded artwork and associated information to create structured data about the work. We refer to this as Artwork Intelligence.

Depending on the artwork and information available, Artwork Intelligence may include:

  • artwork type;

  • medium;

  • visual style;

  • subject matter;

  • dominant and secondary colours;

  • composition;

  • orientation;

  • dimensions;

  • aspect ratio;

  • framing information;

  • mounting information;

  • descriptive attributes;

  • product attributes;

  • searchable characteristics;

  • commerce-related metadata; and

  • other structured information about the artwork.

Artwork Intelligence is designed to make artwork easier to organise, present, search, discover and recommend across digital commerce experiences.

Some attributes may be inferred by AI rather than supplied directly by the artist.

AI can make mistakes.

Where accuracy is important, particularly for information such as artist attribution, medium, dimensions, materials, production methods, edition details or historical information, you should review and correct AI-generated information before publishing it.

5. Does ArtSyncy Train AI on My Artwork?

Unless we expressly tell you otherwise and obtain any consent required by applicable law or our agreement with you, ArtSyncy does not use your uploaded artwork to train a general-purpose ArtSyncy generative AI model.

Your artwork is uploaded so ArtSyncy can provide the services you request.

For example, if you ask ArtSyncy to create a room scene containing your artwork, your artwork may need to be processed by the AI technology responsible for generating that scene.

Processing an artwork to provide a requested feature is different from using that artwork to train a general-purpose generative AI model.

If ArtSyncy's approach to AI training materially changes in the future, we will update this policy and provide additional notice or obtain consent where required.

6. Third-Party AI Providers

ArtSyncy may use third-party artificial intelligence, cloud-computing and infrastructure providers to deliver certain features.

When you use one of these features, information necessary to perform the request may be transmitted to the relevant provider.

This could include:

  • your artwork;

  • generated artwork previews;

  • prompts;

  • generation instructions;

  • metadata;

  • dimensions;

  • frame information; and

  • other information required to complete the requested operation.

ArtSyncy selects and configures providers with the objective of protecting customer content and uses commercial/API services where appropriate.

The handling of information by third-party providers is also subject to the contractual, security and data-processing arrangements applicable to those services.

We may change providers as technology, performance, availability and ArtSyncy's services evolve.

7. Protecting the Integrity of Your Artwork

ArtSyncy is designed to preserve the visual integrity of original artwork when creating commercial assets.

Where your original artwork is inserted into a generated scene, our objective is to avoid unintended changes to the artwork itself.

However, generative AI is probabilistic.

AI-generated imagery or video may occasionally:

  • distort artwork;

  • change colours;

  • alter details;

  • introduce unexpected elements;

  • incorrectly scale an artwork;

  • alter framing;

  • create visual artefacts; or

  • produce other unintended results.

This is particularly relevant to generative video, where objects within an image can sometimes change between frames.

ArtSyncy may use technical controls, prompting, generation rules and other processes designed to reduce these effects, but we cannot guarantee that every AI-generated output will perfectly reproduce the source artwork.

8. Review Before Publishing

You are responsible for reviewing AI-generated assets before publishing or using them commercially.

We recommend checking:

  • artwork integrity;

  • colour accuracy;

  • artwork scale;

  • orientation;

  • frame appearance;

  • room placement;

  • dimensions;

  • written descriptions;

  • artwork metadata; and

  • any AI-generated claims or classifications.

If a generated result does not accurately represent your artwork, it should not be published as an accurate representation of the work.

Where available, you can regenerate, edit or replace the asset.

9. AI-Generated Room Scenes

Room scenes generated through ArtSyncy are intended to help customers visualise artwork in realistic environments.

Generated rooms may be fictional and may contain AI-generated furniture, architecture, lighting, decor, landscapes and other elements.

Unless expressly stated otherwise, these scenes should not be interpreted as photographs of real locations.

The artwork displayed within the scene remains subject to the rights of its owner.

10. AI-Generated Video

ArtSyncy may allow still artwork and room scenes to be transformed into short-form video.

Video generation may introduce movement involving elements such as:

  • camera position;

  • lighting;

  • shadows;

  • curtains;

  • plants;

  • environmental elements; and

  • other elements already present in the scene.

Generative video systems can occasionally alter elements that were intended to remain static.

You should therefore review generated videos carefully to ensure the artwork remains acceptably represented before publishing.

11. Generated Assets and Commercial Use

Subject to your ArtSyncy subscription, our Terms and Conditions, applicable third-party restrictions and applicable law, assets generated specifically for you through ArtSyncy may generally be used to promote and sell your artwork.

This may include use across:

  • ecommerce stores;

  • artist websites;

  • gallery websites;

  • online marketplaces;

  • social media;

  • digital advertising;

  • email marketing;

  • digital campaigns;

  • presentations; and

  • other promotional channels.

AI-related intellectual-property laws continue to evolve.

ArtSyncy cannot guarantee that every entirely AI-generated component will qualify for copyright or other intellectual-property protection in every jurisdiction.

Your underlying original artwork remains separate from this issue.

12. You Must Have Rights to the Artwork You Upload

You may only upload artwork or content that you have the right to use.

This generally means you:

  • created the artwork;

  • own the relevant rights;

  • have permission from the rights holder; or

  • otherwise have a lawful right to process the content.

You must not use ArtSyncy to process another person's artwork without the necessary rights or permission.

This protects artists, photographers, designers and other creators using the platform.

13. Prohibited Content

You must not knowingly use ArtSyncy to upload or generate content that:

  • infringes another person's copyright, trade mark or intellectual-property rights;

  • violates another person's privacy or publicity rights;

  • is unlawful;

  • is fraudulent or deliberately deceptive;

  • contains malicious software or code; or

  • otherwise violates the ArtSyncy Terms and Conditions or applicable law.

We may remove content or restrict access where reasonably necessary to address legal, security or policy violations.

14. Artwork Used in ArtSyncy Marketing

Uploading artwork to your private ArtSyncy account does not automatically give ArtSyncy permission to use that artwork in public advertising, case studies or promotional campaigns.

If we want to feature identifiable customer artwork publicly for promotional purposes outside the ordinary operation of the service, we will seek appropriate permission unless another agreement with you already provides that permission.

This does not prevent ArtSyncy from displaying your artwork back to you within the platform or processing it as necessary to provide the service.

15. Human Access to Artwork

ArtSyncy is designed to minimise unnecessary access to customer content.

In limited circumstances, authorised personnel may need to access customer content for purposes such as:

  • providing requested customer support;

  • diagnosing technical problems;

  • investigating security incidents;

  • addressing abuse;

  • complying with legal obligations; or

  • maintaining and improving service reliability.

Access should be limited to what is reasonably necessary for the relevant purpose.

16. Deleting Your Artwork

Where supported by the service, you may delete artwork and associated assets from your ArtSyncy account.

Deletion from active systems may not immediately remove every copy from backups, logs or temporary processing systems.

Residual copies may remain for a limited period where reasonably necessary for:

  • backups;

  • disaster recovery;

  • security;

  • fraud prevention;

  • legal compliance; or

  • technical operations.

These copies are not intended to remain available for ordinary customer use.

17. Connected Platforms

ArtSyncy may allow you to publish or export artwork information and generated assets to third-party services.

Once content is transferred to another service, that service's terms, privacy practices and data-retention rules may apply.

Deleting an asset from ArtSyncy may not delete copies that you previously published or exported to another platform.

18. AI Transparency

We believe artists and businesses should understand when AI is involved in processing their work.

ArtSyncy will aim to provide clear information about AI-powered features and update our policies as the technology and our services evolve.

Our approach is based on four principles:

Ownership
Your original artwork remains yours.

Purpose
We process your artwork to provide the ArtSyncy services you request.

Control
You decide what artwork you upload and which available AI features you use.

Transparency
We explain how AI interacts with your artwork and update this policy when material practices change.

19. Relationship With Other ArtSyncy Policies

This AI & Artwork Content Policy should be read together with the:

  • ArtSyncy Terms and Conditions;

  • ArtSyncy Privacy Policy; and

  • ArtSyncy Website Terms of Use.

If there is an inconsistency between this policy and the ArtSyncy Terms and Conditions concerning contractual rights or obligations, the Terms and Conditions will apply to the extent of that inconsistency.

20. Changes to This Policy

AI technology and the laws governing it are evolving.

We may update this policy as:

  • ArtSyncy introduces new AI features;

  • AI providers change;

  • our processing practices change;

  • industry standards develop; or

  • legal requirements change.

Where a change materially affects how customer artwork is processed or used, we will provide additional notice or obtain consent where required.
